1.2 This information is published pursuant to paragraph I of Article 1-1 of Law no. 2004-575 of 21 June 2004 on confidence in the digital economy (loi pour la confiance dans l’économie numérique), as amended by Law no. 2024-449 of 21 May 2024. The publisher’s activity is not subject to any authorisation regime and is not a regulated profession. Prices stated on the Site are exclusive of tax and given for information only; only an accepted quote constitutes a price commitment.
Article 2. Publication director
The publication director of the Site is Cédric SANTIAGO, President and legal representative of SANFYTECH. He can be contacted at contact@sanfytech.com.
Article 3. Hosting of the Site
3.1 The Site is stored by the publisher itself, whose name, address and telephone number are given in Article 1, on infrastructure that it administers.
3.2 The physical servers are rented from OVHcloud SAS, 2 rue Kellermann, 59100 Roubaix, France (RCS Lille Métropole 424 761 419) and installed in data centres located in Strasbourg, Roubaix and Gravelines (France), that provider being responsible for the physical security of the premises. The following provisions apply to backups: backups are encrypted at source before transfer; the primary copy is kept in the European Union (Germany) and a mirror copy is kept in France. Certain processing operations ancillary to the operation of the Site may involve a transfer of technical metadata to a third country; these transfers and the safeguards governing them are described in the privacy policy available at https://www.sanfytech.com/legal/confidentialite.
Article 4. Intellectual property
4.1 The elements making up the Site, including texts, images, logos, graphic identity, databases and source code, are the exclusive property of SANFYTECH or its rights holders, with the exception of those identified as belonging to third parties. Photographs, typefaces and third-party software components remain governed by the licences under which they were acquired or made available, and third-party trade marks mentioned on the Site remain the property of their owners.
4.2 Any reproduction, representation, modification, adaptation or reuse, in whole or in part, of the Site or its elements is prohibited without the prior written authorisation of the publisher.
Article 5. Hyperlinks and third-party sites
5.1 The Site may contain links to third-party sites over which the publisher exercises no control: the presence of a link implies neither approval nor warranty, and the publisher is not liable for their content, their availability or the data processing they carry out.
5.2 Links to a page of the Site may be created freely, provided that the link opens the page in a separate window, without framing or confusion as to its origin, and that it does not come from an unlawful site or a site that harms the publisher’s image.
Article 6. Personal data
The processing carried out when the Site is visited, when its forms are used and in the course of the business relationship is described in the privacy policy available at https://www.sanfytech.com/legal/confidentialite, which sets out the purposes, legal bases, recipients, retention periods and the rights of data subjects. These rights are exercised by writing to rgpd@sanfytech.com; any data subject may lodge a complaint with the CNIL (Commission nationale de l’informatique et des libertés, the French data protection authority). SANFYTECH has not appointed a data protection officer, as this appointment is not mandatory under Regulation (EU) 2016/679.
Article 7. Audience measurement, cookies and form protection
7.1 The Site places no advertising cookies or targeting trackers, and no tracker subject to consent: no consent banner is therefore displayed.
7.2 Audience measurement relies on Matomo, self-hosted by the publisher, without cookies or persistent identifiers, the IP address being anonymised before any recording. Raw logs are purged after thirteen (13) months and detailed reports after twenty-four (24) months; only aggregated reports are kept beyond that. The data is neither cross-referenced with other processing nor passed on to any third party. Visitors may object to this measurement in the manner set out in the privacy policy available at https://www.sanfytech.com/legal/confidentialite.
7.3 Forms are protected against automated submissions by the ALTCHA mechanism, also self-hosted: it relies on a computation performed by the visitor’s browser, without cookies, without transmission to any third party and without storing or reading any information on the visitor’s terminal equipment.
Article 8. Availability of the Site and limitation of liability
8.1 The publisher takes due care to ensure the accuracy of the information published and reserves the right to modify its content at any time and without notice, without guaranteeing that it is complete or suited to any particular need. It may suspend access to the Site without notice or compensation for maintenance or security reasons: such access is not subject to any service level commitment.
8.2 The editorial content of the Site is general and informative: it constitutes neither personalised advice, nor a contractual offer, nor an obligation of result. Quantified commitments are those stipulated in the accepted quote, the signed contract and its annexes.
8.3 To the extent permitted by law, and save in the case of fraud, gross negligence or personal injury, the publisher shall not be liable for indirect and non-material damage resulting from access to the Site, its unavailability or the presence of malicious software originating from a third party. Its liability towards users of the online services and towards its clients is governed by the terms of use available at https://www.sanfytech.com/legal/cgu and by the general terms of sale available at https://www.sanfytech.com/legal/cgv, which prevail over this article.
Article 9. Online accessibility
SANFYTECH does not fall within the scope of the entities subject to the accessibility obligation for online public communication services, as the turnover threshold applicable to businesses is far higher than its own, and as the Site offers neither online sales nor online payment. The publisher nevertheless follows a voluntary accessibility approach: semantic structuring of pages, text alternatives for images, keyboard navigation and sufficient contrast. As no compliance audit has been carried out, no level of compliance is claimed. Any access difficulty may be reported to contact@sanfytech.com.
Article 10. Business clientele and consumer mediation
SANFYTECH carries on an activity intended for businesses and the Site offers neither online ordering nor online payment: no consumer mediator has been appointed to date, SANFYTECH’s activity being exclusively business-to-business; if the Client is a consumer or a non-professional, SANFYTECH shall notify it in writing, before the contract is concluded, of the identity and contact details of the mediator it appoints.
Article 11. Reporting content and contact
11.1 Any content on the Site that is manifestly unlawful or infringes the rights of a third party may be reported to contact@sanfytech.com. The publisher acknowledges receipt and examines it. For content stored on behalf of a third party, in respect of which the publisher acts as a provider of hosting services, the notice is governed by Article 16 of Regulation (EU) 2022/2065 of 19 October 2022 and contains: a sufficiently substantiated explanation of the reasons why the content is alleged to be unlawful; an indication of its exact electronic location; the name and e-mail address of the notifier, except where the notice concerns an offence relating to child sexual abuse; and a statement confirming the notifier’s good faith. The publisher acknowledges receipt without undue delay, examines the notice diligently and objectively and notifies the notifier of its reasoned decision and of the available means of redress.
11.2 Where the publisher hosts, on behalf of a client, a site of which it is not the publisher, it acts as a provider of hosting services; responsibility for that content lies with its respective publishers. In that capacity, contact@sanfytech.com is the single point of contact enabling the competent authorities and the recipients of its services to communicate with it electronically, in French or English. Any other question should be addressed to the contact details given in Article 1.
Article 12. Governing law and updates
12.1 This legal notice is governed by French law and drafted in the French language, and only the French version is authoritative. It is an information document: it does not constitute a contract and contains no jurisdiction clause. The jurisdiction applicable to the use of the Site is that stipulated in the terms of use available at https://www.sanfytech.com/legal/cgu and, for the business relationship, in the general terms of sale available at https://www.sanfytech.com/legal/cgv.
12.2 The publisher may amend this legal notice; the applicable version is the one published on the Site on the date it is consulted. The document reference, its version number and the date of its last update appear at the top of the page published at https://www.sanfytech.com/legal/mentions-legales. Earlier versions are provided on request sent to contact@sanfytech.com.
12.3 In the event of conflict between this legal notice and a contractual document, the latter prevails. The order of precedence of the contractual documents is the one laid down in the general terms of sale.
